Aon’s latest claims study found that warranty and indemnity insurance together with standalone tax liability policies have become core elements of transaction structuring in the Asia Pacific region as underwriting capacity expands. The professional services firm reported growing integration of these products in markets such as India, Singapore and South Korea where they help manage risks in large and cross-border deals. According to the study claims outcomes depend not only on policy terms but also on the thoroughness of due diligence, financial review and post-deal integration.
The report placed APAC claims experience as now closely aligned with global patterns with disclosure shortcomings, financial statement errors, regulatory compliance failures and tax exposures representing the leading sources of loss. Aon data showed the firm secured more than $26 million in recoveries from APAC transaction solutions claims over the past three years including multiple high-severity matters. Early activity concentrated in Australia and New Zealand but a second wave has emerged across India, South Korea and Southeast Asia as product adoption accelerates.
High-severity losses exceeding $10 million have become more common on large-cap and cross-border transactions while tax and regulatory claims often surface years after completion creating a distinct long-tail profile the study highlighted. Operational and disclosure issues typically appear within the first 12 months yet tax disputes linked to transfer pricing, withholding obligations or customs duties may arise more than five years later in line with regional audit cycles. The 2026 study noted that larger deals with multi-jurisdictional elements generate both higher notification rates and more complex claims.
Sector patterns vary significantly according to Aon’s analysis with real estate and infrastructure deals facing losses from asset conditions, environmental liabilities and lease commitments. Consumer and retail transactions have seen claims driven by regulatory scrutiny, customer obligations and disclosure gaps while technology and payments businesses encounter issues around licensing, certifications and concentrated contracts. Cross-border structures frequently trigger tax and regulatory exposures on complex financing arrangements the report stated.
North American clients recovered more than $1 billion on transaction solutions claims in 2025 with average payouts surpassing $10 million and median payments reaching $8.2 million both record figures Aon figures show. Globally the firm has supported more than 2,000 claims and secured over $3 billion in total recoveries across its transaction solutions portfolio. The APAC portion of the study reflects a decade-long maturation that has produced deeper insight into frequency, severity and loss drivers as policy volumes increase.
Martijn de Lange, Aon’s managing director of Transaction Solutions in APAC, said, “As the transaction risk market across the Asia Pacific region continues to evolve, claims outcomes are shaped not only by policy coverage but also by the quality of diligence, financial analysis and post-completion integration.” Anita Vivekananda, also a managing director of Transaction Solutions in APAC for Aon, added, “As claims experience deepens across Asia Pacific, clients are becoming more confident in pursuing recovery and leveraging these solutions as part of their deal strategy.” The study anticipates further claims growth as additional policy years mature and buyer familiarity with the products rises.
